Introduced by the Road Safety Act 2006, causing death by careless driving is a relatively new offence.
As with any other careless driving allegation, the prosecution have to prove that you were at fault and that the standard of driving was below that of a reasonable, prudent motorist.
The prosecution must further prove that the person’s death was caused by the manner of your driving.
Death by careless driving can be dealt with either at Magistrates or Crown Court depending on the seriousness of the case.
